ParticipantActually what ennuipoet stated may not be true depending on how Gap does their product development. If they have buyers that exclusively contract with designers in the manufacturing nation (China) then that paragraph is probably the total truth of what would happen if he sued Gap. However, if they have in house design (like JCPenney, Macy’s and Victoria’s Secret does with their private brands) then yes Gap, or more specifically that designer, would bear some responsibility for licensing infringement. However, since laws about works made public on the internet have yet to be tested in court it would be interesting to see what would happen. I’m certain there is no great windfall of cash waiting for this guy, but a couple people in Gap’s back offices will probably get a testy email/slap on the wrist about either not doing it again or altering the image more so that it’s not so obvious.
If they bear any responsibility at all, I bet Gap sends the guy a $50 giftcard as an apology, which is enough to buy half a pair of pants or maybe one glove.

ParticipantPretty neat!

ParticipantEvery day the official Flickr blog features 4-6 pictures around a different micro-theme. The blog and corresponding thumbnails appear in every users login page toolbar, so pretty much everyone who uses Flickr sees it and it’s on the main page as well. That kind of exposure is good for about 1000 image hits an hour + people clicking into your photostream and sets for nearby pictures, especially in this case because the photo selected is one of the ones with our converted IR D50.

ParticipantTo vote, to haver no more, and by a vote to say we end the thousand natural shocks when pictures fail, tis a consummation devoutly to be wished, to vote, to build stats, to make Ultra Farktographer – aye there’s the rub, for in that statistical menu, what respect may come when we have shuffled off this mortal website must give us pause. Tis the fate that makes calamity of such long internet usage, for who can bear the whips and scorns of trolls, the noobs that are wrong, the proud know-it all mega-posters. The pangs of despised rebuttal, the mods delay, the insolence of TFers.

ParticipantThe html code for images doesn’t work on this blackboard but you can use the tags [img ]and [/ img] to enclose the link to the picture and it should display. (Remove the spaces there)

Participantthanks for the suggestion!

ParticipantTBH I’m fine with the no re-use policy. But I understand your desire to keep participating during times it’s more difficult to go out to find subjects so if the consensus was to loosen the rules I still think well performing photos should be eliminated + items used within the last 2-3 years.

ParticipantIf anyone wants some snow please come pick it up at our house. We already got 2 feet 2 weeks ago and we got another 3 inches later that week and 4 inches last week, 3 inches yesterday and it’s been snowing since 10 am today and shows no sign of stopping. Over 50″ in January so far and most of it is still on the ground.

ParticipantAh, very clever but not really where this contest was going. I’m sure you can come up with a use for it in another contest though!
Kestrana
ParticipantCan you give a more specific example? I don’t want to outright say no, but I’m not exactly thinking of anything that would fit the theme and your description.

ParticipantYeah Elsinore let’s stick to terrestrial weather this time.
Lokisbong yeah that’s fine.

ParticipantSo something like a shot of people on the beach would work for nice summer weather?
Well if it’s just some people on the sand I would say no. But if there’s a bright sun that is a prominent feature of the picture in which some hot babes are soaking up rays, then yes that could work.
To clarify:
For pictures in which the main subject isn’t the weather itself, but the evidence of weather, the subject should be directly affected or interacting with the weather – i.e. someone fighting with an umbrella, with hair and clothes windblown or tanning.

ParticipantThanks Cause. We try to be each other’s biggest cheerleaders rather than being competitive so I’m very happy his idea did so well. And hey, I got to be in the picture so that’s cool. But I did find it funny that the barn was my highest vote-getting picture of all time and it didn’t win 😛
Kestrana
ParticipantIf it’s evidence of any of the forms of weather, I would consider that fair game as long as it’s obvious in the picture what the relationship is.
