ParticipantAh, Capitalism! This is how this will break down. The Gap with it’s resources will start by claiming the photo in question is NOT the same one used on the clothing, and even if it were, which it isn’t the Gap is not responsible. No, you see, the Gap merely purchased the shirt from the manufacturer and is not responsible for how the manufacture obtained the content, not that the content is the same, because it isn’t. The manufacturer will claim that the content is clearly different, and even if it were, which it isn’t, they are not responsible because they purchased the shirt design from a company in China, and THAT company is really responsible in the event the content is stole, which it isn’t. The design company in China will simply never respond to claims because it is in China and therefore untouchable by American law. Meanwhile the photographer in question will shortly be sued by the car company which will claim that the image of the vehicle itself is copyrighted by the car company and ANY commercial use of that image entitles the car company to the profits from the image and any derivative works. The photographer will win in court, but the legal fees will force the photographer to sell their cameras to pay the lawyers. The lawyers from the Gap, the t-shirt manufacturer and the design company in China will all make incredible amounts of money compiling legal briefs for the corporations about how the photo isn’t the same and even it was, which it isn’t, the companies are not at fault. The only real loser here is the photographer that dared to question the theft of their work and any dumb enough to buy a product that stupid at the Gap.

ParticipantI saw that yesterday, I didn’t notice that it was you! Freaking awesome. You can’t pay for that kind of exposure. Of course, that kind of exposure and $12.00 will get you a cup of coffee at a Manhattan Starbucks 🙂
This:

is my highest viewed pic, Blackwolf the Dragonmaster. I submitted it as an “O” for a Photoshop contest and it went green netting over 7k hits. My Improv Everywhere not pants ride Set has 12k hits.My other highest grossing pics are all either Fark Pshop of naked boobies. 😳

ParticipantCongrats to ravnostic this week!
😀
I’m absolutely thrilled and somewhat shocked–there were some really outstanding shots this week that I thought would overtake me. I know other’s have had a 1st/2nd combo–how common is that? Anyone gotten 1-2-3 before (U-Man, I’d bet)? One must have something to which to aspire. 😉
I landed a 1st/3rd in Reflections Two: Electric Boogaloo. It made me feel FUNNKKKAAAYYY

ParticipantTo vote, to haver no more, and by a vote to say we end the thousand natural shocks when pictures fail, tis a consummation devoutly to be wished, to vote, to build stats, to make Ultra Farktographer – aye there’s the rub, for in that statistical menu, what respect may come when we have shuffled off this mortal website must give us pause. Tis the fate that makes calamity of such long internet usage, for who can bear the whips and scorns of trolls, the noobs that are wrong, the proud know-it all mega-posters. The pangs of despised rebuttal, the mods delay, the insolence of TFers.
Damn, where is my copy of Othello! I can’t let myself be one upped like this!:D

ParticipantI am in the midst of a dilemma:
To Boobie or Not to Boobie, that is question? Whether this nobler in the thread to proffer the breast of nubile young women, or take shots of puppies and kittens, and by my posting rend votes for them. To vie for votes cheap, and in that cheap way, gain more, and by that cheap way suspend, the heartache of thousand low vote threads, that my shots are heir to, tis a consummation devoutly to be wished!

ParticipantI am a strong proponent of the One Shot/One Thread Rule. By eliminating previously used shots it forces me to go out and shoot more. It also forces me to think creatively about what I am shooting. Admittedly, I am a moderately prolific shooter with an image archive spanning years and approaching 10K images, so I can rely on that archive to have something I can MAKE fit a theme, others may not have that safety net.
As far as organizing, I label all my FTog Shots with that in the metadata and post them to a specific Flickr set which I can rapidly review.

Participant//Apparently, you aren’t too far off. How much do you charge for a tea leaf reading?
Merely a third of your vote total attributed to any one of my pics 😛
Seriously good shots all this week, a broad and esoteric selection of weathers.
As far as over all vote totals, watch next week for a major spike. Farkers can’t resist rewarding Vote Whores with their votes!

ParticipantWhat do you guys think of when you think of Maine?
You pretty much hit it for me – Stephen King and nature.
And thanks to Stephen King and nature I also associate Maine with all things Supernatural. So, vampires, undead children, the Devil and clowns in the sewers would also fit in this theme! 😛

Participantrav: As a Fark Photoshopper I know a fair bit about vote whoring. The text in a Vote Whore is not at all relevant to the whoring going on. The whoring is always in the image. Thus a nubile woman scantily attired will attract scads of votes even if, say, Bible verses are slapped on the top. Even in the Caturday threads, the text is secondary to the “Awwwwwww” factor of the cat. Be proud, whore photos for all they are worth! You don’t need text, just a firm set of boobies, small cute kitten or firemen without their shirts!
All of which I will be using in this contest!

ParticipantLong and short of the answer is this: it depends.
Different states have different laws regarding this sort of thing. On the veneer, you retain full rights to your photographs. Unless you signed a derivative works contract that is worded in such a way that your employer retains those rights. Since you are photographing proprietary information and technology of the company, they could stop publication based on that. If for some reason you were looking to publish, this would be most likely venue to block it.
You should definitely negotiate a separate agreement for your photography, clearly defining the rules and compensation of any and all photo work you do for your company. Whether or not you are considering publishing or just looking to be compensated for your time and energy, this is a must.

ParticipantUpon reading your stories about getting those shots, I figured the least you guys could do would be to find a way to warm each other up good and proper. I suspect you’re both creative enough to find a suitable method.
You mean like those little pocket hand warmers? Those are awesome!
